Moderates?

The so-called 'Moderates' in this article are criticizing a distinguished professor for objecting to a state attempting to kill a man; seems like quite the misnomer to me. First, there is no capital punishment in Canada. Second, even in the US, Awlaki wouldn't be subject to the death penalty for any of the alleged crimes he has committed. Third and most important, any state attempting to assassinate an individual without a fair trial and due process is probably the greatest travesty to democracy and Western civilization.
So it seems these 'Moderates' should check their own ideology when getting caught up in an obviously partisan attack to discredit an individual who they take issue with.
